The pension system for civil servants in Ukraine remains complex and often unclear.
Constant changes in legislation, differing interpretations by various authorities, and bureaucratic hurdles mean that a former civil servant’s pension can end up significantly lower than what the law provides.
Recalculation of a civil servant’s pension is a procedure that allows the already-awarded benefit to be reviewed in light of new circumstances: increases in pay for active civil servants, higher allowances, changes in legislation, or the discovery of calculation errors.
For many of our clients, recalculation becomes the way to obtain a fair amount that matches their length of service, position, and merits. This is not only about finances—it’s also about respect for years of public service.
Who is entitled to a recalculation
The right to recalculate civil servants’ pensions is set out in laws and by-laws. In practice, it typically arises in two situations:
- after the pension was awarded, pay for your former position changed (updated pay grid, higher base salaries, new permanent allowances);
- errors were made at the time of initial pension award—civil service tenure wasn’t fully counted, rank/long-service allowances were omitted, regular bonuses or intensity pay weren’t included, and/or incorrect indexation coefficients were applied.
Categories of persons who usually have the right to a recalculation include:
- employees of central executive authorities (ministries, state agencies, inspectorates),
- officials of local self-government bodies,
- staff of court administrations and prosecution bodies,
- officials of regional/district state administrations and territorial units of central authorities.
The key factors are that the position qualified as public (civil) service and that there is documented civil service tenure—typically at least 10 years.
We also draw special attention to cases where, after being granted a pension, a person continued working in the civil service for some time. In such cases, recalculation is possible taking into account the additional tenure acquired, as well as changed pay conditions for the relevant position. In addition, an official increase in base salaries or the introduction of permanent (non-one-off) monthly allowances for active civil servants is a ground for recalculating the pension base.
At the same time, there are limitations. If your civil service tenure is insufficient, or your pension was granted under other special laws (e.g., military or academic pensions), the recalculation mechanism may differ. Another common problem is the absence of properly issued salary certificates—but this can be fixed: we help obtain additional certificates from former employers or archives to prove actual payments and their regularity.
When to apply
Apply as soon as discrepancies are identified. Typical red flags: you and a former colleague with the same tenure and position receive pensions that differ by 20–40%; you learn about pay increases in your former body; your salary certificate omits monthly bonuses/allowances that were in fact paid; your employment record lacks entries on rank or periods of service; the Pension Fund (PFU) refused, citing “no mechanism” or “insufficient documents.”
Practical examples.
- A client was not credited with a long-service allowance and a monthly bonus, which understated the calculation base by 18%. After requesting new certificates and filing an application with the PFU, the pension was recalculated and the 14-month difference was paid.
- A former department head was not credited with six months of service due to an error in the employment record date. After correcting the entry and filing a claim, the court ordered the PFU to recalculate the pension taking full tenure into account.
Why it’s important not to delay
First, you lose part of your lawful pension every month. Second, time limits matter—although a court may restore missed deadlines for valid reasons, it’s better to act promptly to obtain retroactive payments in full. Third, documents (certificates, archived data) are easier to obtain while authorities still have them readily available.

FAQ
Do all civil servants have the right to a recalculation?
No. It depends on the position, tenure, and pension award conditions. Even if you’re unsure, a lawyer can review your documents and confirm or deny eligibility.
What documents are needed for a recalculation?
Passport, tax ID, employment record book, salary certificates (including bonuses and allowances), the pension award decision, and other supporting documents. In many cases, we help obtain missing certificates.
How long does the procedure take?
In the best case, 1–2 months if the PFU accepts the documents. If court action is needed, the process may take 4–6 months, but arrears are still calculated from the date of application.
Is it possible to get a recalculation without going to court?
Yes, when the Pension Fund acts in compliance with the law. However, in more than half of cases practice shows that court action is required.
What if the Pension Fund refused the recalculation?

Are bonuses and allowances considered in a recalculation?
Yes. They must be confirmed by official certificates and paid regularly rather than one-off. Case law confirms such payments must be counted.
Can a recalculation be made retroactively for previous years?
