What Happens If You Don't Register for Military Service: Fines, Consequences, and How to Protect Your Rights
Failure to register for military service during a special period may result in a fine of UAH 17,000–25,500 under Article 210 of the Code of Ukraine on Administrative Offenses. Criminal liability does not arise automatically: under Article 337 of the Criminal Code of Ukraine, evasion must be proven after an official warning from the head of the competent authority. A fine can be appealed due to lack of evidence, improper notification, procedural violations, or missed deadlines. After receiving the resolution, you should record the date of service and not miss the ten-day deadline.

What military registration is and who must be registered
Military registration is a system for collecting, verifying, and updating information about conscripts, persons liable for military service, and reservists. Its purpose is to have reliable data on human resources needed to staff the Armed Forces of Ukraine and other military formations. Being registered does not in itself mean automatic mobilization. This is a separate legal obligation that exists regardless of whether a person has the right to deferment.
Who belongs to conscripts, persons liable for military service, and reservists
The law distinguishes several categories of citizens. Conscripts are persons registered for conscription; under the current Article 37 of the Law of Ukraine “On Military Duty and Military Service,” such registration includes, in particular, citizens under the age of 25. Persons liable for military service are persons in the reserve for staffing military formations during a special period and performing work to support defense. Reservists serve in the military reserve and are intended to staff military units in peacetime and during a special period.
Mandatory registration applies not only to men. Women who have obtained a medical or pharmaceutical specialty and are fit for military service by health condition and age are also registered as persons liable for military service. For women with other related specialties, registration is generally voluntary.
Legislative regulation
The main rules are established by the Law of Ukraine “On Military Duty and Military Service”, the Law of Ukraine “On Mobilization Training and Mobilization”, and the Procedure for Organizing and Maintaining Military Registration No. 1487. Liability is determined by the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine.
What obligations a person liable for military service has
A person must be properly registered, have a military registration document, report changes defined by law, appear upon a proper summons, and provide accurate information.
Military registration
A person must register for military service in cases directly provided for by Article 37 of Law No. 2232-XII and Procedure No. 1487: after acquiring the relevant status, arriving at a new place of residence, being discharged from military service, termination of grounds for exclusion, or in other situations established by law. According to the Rules of Military Registration, after arriving at a new place of residence, a person must personally appear before the competent authority within seven days with a passport and military registration document.
Updating military registration data
Changes in personal data defined by the law on the Unified State Register of Conscripts, Persons Liable for Military Service, and Reservists must be reported within seven days through the electronic account or in person at the authorized body.
The notes to Articles 210 and 210-1 of the Code of Ukraine on Administrative Offenses provide that these articles do not apply when the Register holder can obtain personal data from other state registers. However, it is advisable to check whether the information is actually displayed correctly.
Notification of change of place of residence
A change of address must be reported within seven days. After arriving at a new place of residence, it is necessary to register at the new address if the specific situation requires it. Lack of registration does not cancel the obligations, but the TCC must prove the violation and guilt.
What happens if you do not register for military service
The most common consequence is administrative liability. However, an entry in the database is not yet a fine: an official must establish the elements of the offense and issue a resolution.
What fines are provided
Article 210 of the Code of Ukraine on Administrative Offenses establishes liability for violation by conscripts, persons liable for military service, and reservists of military registration rules. In an ordinary period, the fine ranges from 200 to 300 non-taxable minimum incomes of citizens, that is, from UAH 3,400 to UAH 5,100. For a repeated violation within a year for which the person has already been held liable, or for a violation during a special period, the fine ranges from 1,000 to 1,500 non-taxable minimum incomes — from UAH 17,000 to UAH 25,500.
Article 210-1 of the Code of Ukraine on Administrative Offenses concerns a wider range of violations of legislation on defense, mobilization training, and mobilization. For citizens in an ordinary period, a fine of UAH 5,100–8,500 is provided; for a repeated violation within a year — UAH 8,500–11,900; and during a special period — UAH 17,000–25,500. The correct qualification depends on which specific obligation was violated; the TCC and SP cannot arbitrarily choose an article without specifying the rule.
| Violation | Legal provision | Liability |
| Failure to register for military service or another violation of registration rules | Art. 210 of the Code of Ukraine on Administrative Offenses | UAH 3,400–5,100; during a special period or for a repeated violation within a year — UAH 17,000–25,500 |
| Failure to report changes in registration data within the established period if the information cannot be obtained from other registers | Art. 210 of the Code of Ukraine on Administrative Offenses, Procedure No. 1487 | During a special period — UAH 17,000–25,500 |
| Violation of mobilization legislation, in particular failure to fulfill a properly proven mobilization obligation | Art. 210-1 of the Code of Ukraine on Administrative Offenses | For citizens during a special period — UAH 17,000–25,500 |
| Damage to a military registration document or its loss through negligence | Art. 211 of the Code of Ukraine on Administrative Offenses | Fine from 30 to 50 non-taxable minimum incomes; for a repeated violation within a year — from 50 to 100 minimums |
| Evasion of military registration after an official warning from the head of the competent authority | Part 1 of Art. 337 of the Criminal Code of Ukraine | Fine of UAH 5,100–8,500 or corrective labor for up to one year; this is criminal, not administrative, liability |
Repeated violation
For repetition, the person must commit a new violation within a year after a previous penalty. The TCC must confirm the validity of the first resolution and the new episode. During a special period, Article 210 already provides for an increased sanction, and a person cannot be punished repeatedly for the same act.
Other possible consequences
Lack of registration may complicate employment, reservation, obtaining a military registration document, and certain consular services. In specific cases, the TCC may contact the police regarding delivery. Only a court, upon a claim by the TCC, may restrict the right to drive a vehicle, and a mark about a violation or wanted status in the Register is not equal to a verdict.

Who has the right to impose a fine
Powers of the TCC and SP
Under Article 235 of the Code of Ukraine on Administrative Offenses, cases under Articles 210, 210-1, and 211 are considered by territorial recruitment and social support centers. On behalf of the TCC and SP, heads of TCC and SP have the right to impose penalties. Special rules and the competence of the relevant bodies apply to persons liable for military service and reservists who are in the reserve of the Security Service of Ukraine or the Foreign Intelligence Service.
Procedure for bringing to administrative liability
Usually, the circumstances of the violation are recorded, a protocol is drawn up, the person’s rights are explained, they are given the opportunity to provide explanations and evidence, after which the competent official considers the case. The person has the right to know what they are accused of, review the materials, use the assistance of an attorney, file motions, and appeal the resolution.
During a special period, a protocol may not be drawn up in cases defined by law, in particular when receipt of a summons and failure to appear without a valid reason are confirmed. A penalty under Articles 210 and 210-1 may be imposed within three months from the day of detection, but no later than one year from the day the violation was committed. The resolution must contain specific facts, evidence, and the appeal procedure.
Can criminal liability arise?
In which cases
Part one of Article 337 of the Criminal Code of Ukraine provides liability for evasion by a conscript, person liable for military service, or reservist from military registration after a warning issued by the head of the relevant TCC and SP, SBU body, or Foreign Intelligence Service unit. The sanction is a fine from UAH 5,100 to UAH 8,500 or corrective labor for up to one year.
For criminal proceedings, it is not enough to establish absence from registration. An official warning, awareness of the requirement, the ability to fulfill it, and evidence of intentional evasion are required. Valid reasons and improper service of documents affect the assessment.
Article 337 should not be confused with Article 336 of the Criminal Code of Ukraine, which concerns evasion of conscription for military service during mobilization. Failure to register and evasion of mobilization are offenses with different elements.
How it differs from administrative liability
An administrative offense may consist of failure to comply with a specific registration rule, including missing a deadline. Article 337 of the Criminal Code of Ukraine requires qualitatively different behavior — intentional evasion after a special warning from a competent head. A criminal accusation is investigated by a pre-trial investigation body, and guilt is established by a court. The head of the TCC and SP cannot, by their resolution, find a person guilty of a criminal offense.
How to appeal a fine for failure to register for military service
Before choosing a defense method, you need to obtain a copy of the resolution and case materials. It is worth checking the date and method of notification of the hearing, the protocol, proof of service of summonses, extracts from the Register, written explanations, documents on valid reasons, and the authority of the official.
Administrative appeal
The resolution can be appealed to a higher authority or official. The complaint should specify the details of the resolution, circumstances, violated provisions, the demand, and attach evidence. The method of submission must confirm the date of dispatch.
You should not assume that an administrative complaint automatically extends the deadline for going to court. If the ten-day deadline is expiring, simultaneous filing of a claim should be considered.
Judicial appeal
The claim is filed with the local general court as an administrative court. The claimant may request that the resolution be canceled and the administrative offense case closed, or choose another demand depending on the circumstances. The defendant is usually the relevant TCC and SP as a public authority, not only the official who signed the resolution.
The lawfulness of the decision is proven by the defendant, but the claimant should provide their own documents. Grounds for the claim may include lack of evidence of guilt, incorrect qualification, improper notification, failure to consider valid reasons, missed deadline, or repeated punishment for the same act.
Deadlines for applying
Under Article 289 of the Code of Ukraine on Administrative Offenses, a complaint against a resolution can be filed within ten days from the day it is issued. A different starting point applies to resolutions in the field of road safety, but this special rule does not apply to TCC fines. A deadline missed for valid reasons may be restored upon the person’s application.
If the claim is filed after ten days, a reasoned application for renewal of the deadline is required. Evidence of the date of receipt may include the envelope, delivery notice, electronic cabinet screenshot, or application for issuance of a copy.
Court practice regarding TCC fines
Typical grounds for canceling resolutions
Courts cancel resolutions if the TCC and SP did not prove the specific elements of the offense, did not provide proper evidence in the resolution, did not confirm service of the summons or notification of the case hearing, deprived the person of the opportunity to provide explanations, incorrectly applied the article or sanction, or missed the limitation period.
In the official summary of court practice regarding TCC decisions, significant deficiencies include the absence of evidence in the resolution and lack of confirmation that the person was notified of the case hearing. At the same time, the resolution may remain in force if the obligation, service of documents, and violation are properly proven.
Positions of the Supreme Court
In its ruling of July 8, 2020 in case No. 463/1352/16-а, the Supreme Court formulated a general approach for administrative offenses: doubts about the event and guilt are interpreted in favor of the person, and an unproven event and guilt are equated with proven innocence. Therefore, the TCC cannot shift the burden of proving innocence to the citizen, and the resolution itself does not replace evidence.
The right to be notified of the hearing and provide explanations is also important. The court checks not only an entry in the Register, but also the specific obligation, the deadline for fulfilling it, the availability of data through other registers, guilt, and the TCC procedure. A reference to another case does not replace one’s own evidence.
Typical mistakes of persons liable for military service
Mistakes when updating data
Updating data should not be equated with registration, documents should not be submitted without proof of acceptance, and an incorrect status in the Register should not be ignored. An error in the application should be recorded and an official request should be submitted.
Mistakes when receiving summonses
Refusal to sign does not always mean that the summons has not been served: an act of refusal may be drawn up. The date of appearance must not be ignored, and a valid reason must be reported and its evidence preserved.
Mistakes when paying a fine
Payment of the fine does not eliminate the registration violation: the status must still be resolved. Payment should be made only using verified details and indicating the resolution number.
If the person does not dispute the violation and, before the hearing, submitted a special statement of consent to be held liable in their absence, Article 300-3 of the Code of Ukraine on Administrative Offenses allows the resolution to be executed by paying at least 50% of the fine within ten calendar days from the day it enters into force. This is a special procedure, not a general discount for any TCC fine. Admission of the violation may contradict a later position in court, so before submitting such a statement, it is worth assessing the evidence.
Checklist: what to do if you did not register for military service
- Check your status in the electronic military registration document and determine where you should be registered.
- Prepare your passport, military registration document, and evidence of place of residence, education, service, health condition, or deferment.
- Contact the TCC in a lawful way and keep the ticket, incoming number, attachment description, and delivery notice.
- Explain the reasons for the delay in writing and attach evidence. Do not sign unclear documents without comments.
- If a protocol is drawn up, provide explanations, request a copy, and demand that your evidence be attached.
- After receiving the resolution, record the date of service and request the case materials.
- Decide whether you admit the violation and pay the fine or appeal the resolution within ten days.
- After paying or canceling the fine, complete registration and check the data in the Register.

Conclusions
If a person does not register for military service, the most likely legal consequence in 2026 is an administrative fine of UAH 17,000–25,500, since a special period is in effect in Ukraine. However, the TCC and SP must prove the specific violation, guilt, compliance with deadlines, and procedure. An entry in the Register by itself does not cancel the person’s right to explanations and judicial protection.
Criminal liability under Article 337 of the Criminal Code of Ukraine is possible only for intentional evasion of registration after an official warning from a competent head. If the fine has already been issued, there should be no delay: the appeal period is short, and timely collected documents often determine the result of the case.
